Latitudes Conditions of Sales

Terms

By accepting a quotation or an invoice from Latitudes.Online (“Latitudes”), you (“the client”) explicitly or tacitly agree to and are bound by the terms and conditions laid out below. Latitudes shall ship your purchase after full and complete payment of your invoice.

Final Shipping Costs:

  • The shipping quotation provided may be subject to change. The final invoice issued by Latitudes shall be considered the final cost of the shipping service for one month only. If the invoice is not settled within this period, the shipping quotation is no longer valid and may be subject to change.

Exchange Rates:

  • Where applicable, the exchange rate is applied to an acquisition is fixed on the day the final invoice is issued by Latitudes. If an invoice remains outstanding for more than fourteen days from the date of issue, the exchange rate may be subject to revision.

Shipping Address:

  • The client must provide a physical address as the destination for the goods. A PO Box, parcel locket address, or incorrect physical address may result in unsuccessful delivery, for which Latitudes and its supplier shall not be held liable.

Insurance:

  • Insurance of the goods is not included in the quotation or invoice unless specifically agreed upon with Latitudes. Latitudes shall not be held liable for any damage or loss if the client has not insured the shipment.

Liability:

  • Latitudes shall not be held liable for any harm resulting from the conduct of third party shipping suppliers, including but not limited to negligence, gross negligence, or willful intent. Such harm includes damage to the goods, delay, late delivery, or lost delivery.

Delivery Deadlines:

  • Latitudes undertakes to deliver acquired artworks to the client in a timely manner. In the event of a missed delivery deadline, Latitudes shall not be held liable for any delays.

Additional Costs:

  • The client may be responsible for additional costs, including but not limited to customs duties, taxes and “return to sender” shipping costs and fees. The client agrees to settle these amounts directly with the relevant Latitudes’ supplier on request and understands these amounts are not included in the quotation provided by Latitudes.

Damages, Refunds and Return:

Kindly note in advance that, owing to the unique nature of art, returns are not always guaranteed. If Latitudes has facilitated your acquisition, and you wish to return a work or request a refund, please notify a member of our team within seven days of the receipt of the work. Unless an artwork arrives and it is meaningfully not as described or arrives damaged, the return shipping costs must be pre-paid and the order fully insured at the collectors’ expense, unless otherwise stated. If your artwork arrives, and it is meaningfully not as described, does not arrive, or arrives damaged, Latitudes will work with you to find the best solution. If transit insurance is in place, and the work does not arrive, or arrives damaged, Latitudes Online will oversee and manage the insurance claim process to replace the work or secure a full refund for you. Latitudes Online will make a determination whether your item is significantly not as described. A difference of description must meaningfully impact the value or nature of the item. All dimensions are approximate.
What is covered:

  • Different colour dependent on light

  • Details that are intrinsic to the creation of the work (e.g. incidental brushstrokes)

  • Negligible differences in dimensions

  • Delays: shipping company or customs processes

  • Unpaid customs - duty of collector

  • Issues related to sales concluded without Latitudes Online's involvement, including referral sales 

What is not covered:

  • Items not as described must be reported within 7 days of receipt

  • Items not received must be reported within 14 days of the latest expected delivery date

  • Provide any requested photographic evidence of the issue (including the artwork and the original packaging).

  • Keep all the internal and external packaging in case needed for inspection in the event of an insurance claim.
